Tesco Stores Limited, Great Britain applied to the Patent Office of the Republic of Poland to extinguish the protection of the international graphic mark IR645606 granted to Lidl Stiftung & Co. KG, Germany. This mark was filed on April 4, 1995. in as many as 18 classes, while in Poland it was registered for classes: 30, 31, 32 and 33.
In 2020 there was widespread information that the TESCO chain of stores is being bought in Poland by the Netto chain and that TESCO remains a store operating only in Great Britain. So why did TESCO try to extinguish the logo in Poland? For many years, TESCO has been in dispute in Great Britain with the LIDL chain of stores. TESCO is trying to use a very similar mark in Great Britain, which LIDL does not agree to. The dispute in Poland is intended to put pressure on the LIDL chain to allow the TESCO chain to use the mark.

What will be the effect of the above dispute? The hearing has been postponed, so there is no final decision yet.
